The newly christened Utah Mammoth have initiated judicial proceedings at the federal level against a company specializing in hockey equipment located in Oregon. This action intensifies a dispute concerning trademarks, specifically regarding the employment of the term “Mammoth” and associated branding. The legal filing, submitted this week to the U.S. District Court in Utah, identifies Mammoth Hockey LLC as the party being sued. The objective is to settle a disagreement pertaining to naming rights between the involved organizations, as detailed in documents acquired by the Associated Press.
Smith Entertainment Group, which oversees the operations of the Utah Mammoth in the NHL, asserts its legitimate entitlement to the team name. They cite both state and federal trademark legislation, contending that their branding strategies do not adversely affect the equipment manufacturer’s commercial activities. The Mammoth formally presented its official designation and emblem in May, subsequent to the team’s relocation from Arizona. During their initial season in Salt Lake City, they temporarily operated under the title “Utah Hockey Club.”
Shortly after this announcement, Mammoth Hockey dispatched a formal letter demanding cessation of use, expressing opposition to the application of the name and the mammoth-themed logo. The company voiced concerns that the resemblances between the brands could result in confusion among consumers, potentially undermining its promotional capabilities targeting hockey enthusiasts and participants. The company’s history involves producing extra-large hockey gear carrying bags from 2014 onward.
“Mammoth Hockey intends to vigorously defend the litigation recently commenced against it by Utah Mammoth of the National Hockey League and protect its longstanding trademark used in connection with the hockey goods it has manufactured and sold for the past 10 years,” Mammoth Hockey co-founder Erik Olson said in a statement to the Deseret News.
Both entities utilize a mammoth figure within their respective logo designs and function within a related industry. This circumstance elevates the possibility of brand identity overlap across retail outlets and virtual platforms. The Utah Mammoth are preparing for their second season in the NHL and their inaugural season bearing their definitive moniker.
