The NCAA’s Most Recent Update to Members
On Tuesday, the NCAA distributed the following communication to its affiliated schools. [emphasis added]
To Our Associates,
An accelerated briefing schedule has been mandated by the Tenth Circuit regarding our petition for a stay while the appeal is pending. Class representatives must submit their response to our urgent motion by Friday, August 14. Subsequently, the NCAA has until Monday, August 17 to submit its final reply. For the time being, the Wisne [otherwise known as Colorado] injunction continues to be active.
A thorough review was conducted by the Division 1 Cabinet, which incorporates student-athlete representation, on whether to apply the age-related eligibility policy retrospectively. Ultimately, it was determined that retroactivity would not benefit either existing or future collegiate competitors. We remain committed to supporting and aggressively protecting this collective choice. We believe this injunction was issued in error and have petitioned the Tenth Circuit for a complete and permanent reversal.

The lawyers representing the NCAA consulted the D1 Cabinet, asking, “So, are we staying the course on this battle, or is it time to walk away?” The response from the D1 Cabinet was, “Well, can you actually secure a victory this time?” The legal department, likely dreaming of purchasing a shiny new red Ferrari, responded, “Without a doubt. This one is a guaranteed win.”
